NZMP started at the request of the New Zealand Resident Doctors Association to provide medical malpractice and liability cover to its members from a New Zealand owned and operated company.

On 9 December 1999, we were incorporated to underwrite professional indemnity insurance for New Zealand medical and health workers.

RMO INSURANCE

Resident Doctors’ Indemnity Insurance

Resident Doctors (or RMOs) have long complained that where malpractice issues arise involving RMOs and Senior Doctors, the potential for a serious conflict of interest exists.

In addition RMOs have been concerned about malpractice suits and disciplinary proceedings not being defended or being settled at the expense of the individual’s reputation.

NZMP in conjunction with Professional Broker Services and NZRDA have developed a binding Professional Liability Insurance programme specifically for RMOs which ensures independent representation. The programme provides a comprehensive service enabling RMOs to have more control over events affecting their medical careers.

What are you covered for?

You are covered for medical malpractice and disciplinary proceedings meeting all costs and liabilities as of right up to $2 million. You are also covered where you are undertaking any medical duties or functions including working in “Accident & Emergency Clinics” or providing locum cover.

You are covered for penalties and costs awarded against an individual and legal costs and expenses incurred in the investigation and defense of any action or enquiry brought against you.
You are also covered for actions brought against you when you are no longer an RMO provided these related to medical duties or functions performed by you whilst an RMO.

Costs and out of pocket expenses up to $20,000 which you incur in attending any enquiry, court case or the like brought against you are also included.
Further, a payment of $100.00 per day made to cover payment for lost earnings where you are required to attend any enquiry, court case or the like is included.

IMPORTANT NOTE: Reference should be made to the policy wording held by the NZMP. As with any insurance cover, the above statements are subject to the terms, conditions and exclusions of the relevant policy.

SMO INSURANCE

As a Registered Medical Professional you face many new and changing risks in your everyday activities. With the introduction of the Accident Rehabilitation and Compensation Insurance Act 1992 and the Privacy Act 1993 coupled with recent changes to the public health system, mental health and other legislation, you need to ensure that you are FULLY protected. Ask yourself:

  • Will your current arrangements provide independent and competent legal assistance when necessary?
  • Are you going to be reimbursed for your out of pocket expenses and lost earnings when attending proceedings?
  • Do you have a legally enforceable contract of insurance which spells out the level and extent of protection that you have paid for?

The New Zealand Medical Professionals’ Medical Indemnity Insurance Policy is a legally binding contract of insurance which provides medical professionals with comprehensive insurance protection. The policy provides the following cover:



1. Medical Malpractice Indemnity

This will cover any costs or damages awarded against you in medical malpractice/negligence claims as well as paying for legal and other defence costs, whether the case against you is successful or not.

2. Legal and Disciplinary Defence

This will cover legal costs and expenses incurred in the defence of any action or enquiry brought against you such as medical discipline hearings, Committees of Enquiry, Court Martial, ACC Enquiries, Privacy Complaints Tribunal, Coroners’ Courts and the like.

3. Loss of Earning

This will provide a payment of up to $1000 per day or part day (or subject to a maximum of $15,000) where you are required to attend any action or enquiry brought against you and where you have suffered loss of earnings as a result of such attendance.

How much cover do you get?

The insurance will pay up to $4,000,000 per annum under the Medical Malpractice Indemnity and Legal and Disciplinary Defence Costs sections of the cover, subject to a limit of $2,000,000 per incident. Included is cover for up to $250,000 in respect of punitive and exemplary damage claims.

The insurance will also help pay up to $20,000 per annum under the Expenses Reimbursement section of the cover.

What about your past activities?

Apart from current or pending claims or complaints against you, the policy will respond to any claims arising from medical duties or functions performed by you prior to you taking the insurance cover.

ALLIED HEALTH INSURANCE

Allied Health Indemnity Insurance

This provides cover for each person up to:

• $500,000 in respect of each and every claim
• $1,000,000 in total during the insurance period

This section of the cover does not involve any excess i.e. all claims are paid in full up to the amount of cover.Cover includes the costs awarded against you as well as paying for legal and other defence costs, whether the case against you is successful or not.

Amount of cover – $1,000,000 per annum. Claims will not be subject to deduction of any excess.

Legal and Disciplinary Defence Costs

Following allegations of negligence and arising out of claims by others against you, disciplinary enquiries or coroner court enquiries.
This is included in the $1,000,000 cover for Professional Indemnity.

Loss of Earning

As a result of a claim arising out of a court of enquiry where your salary is suspended.
Amount of cover up to $1,000 per week for a maximum of 13 weeks.

What is not covered by the plan?

Like all insurance policies, there are a number of exclusions.  These are reasonable and full details are contained in the policy.

Who qualifies for the scheme?

This plan is available to all registered, qualified health professionals other than nurses, doctors and specialists.
